Terms of Service

These terms govern your use of Smart Gallery Hub (“SGH”) and the purchase of Smart Gallery Hub Pro. By using the software or purchasing a license, you agree to these terms.

Free and Pro

Smart Gallery Hub is free to download and use, with no time limit. Smart Gallery Hub Pro unlocks additional features, as listed on our pricing page.

License grant

Upon purchase of Smart Gallery Hub Pro, you are granted a personal, non-exclusive, non-transferable license to use the Pro features on up to 5 (five) devices that you own or control.

Pro plans

  • Pro Annual is a yearly subscription. The Pro features stay active while your subscription is active, and it renews each year unless you cancel it. If your subscription ends, SGH keeps working as the free version.
  • Pro Lifetime is a one-time payment. Your license does not expire: the Pro features stay active, including in all future versions, with no renewal and no further payment.

Updates

Updates and new versions of SGH are free to download for everyone. Which features you can use in a new version depends on your plan, as described above.

Trial

Every new installation includes a 30-day free trial of Pro, with full Pro functionality. No credit card is required. When the trial ends, SGH keeps working as the free version, and you can buy Pro at any time to unlock the Pro features again.

Activation limit

Each license key may be activated on up to 5 devices. If you need to transfer an activation to a new device, deactivate the old device first through the application settings, or contact support for assistance.

Acceptable use

You agree not to:

  • Redistribute, resell, or sublicense Smart Gallery Hub or your license key
  • Reverse-engineer, decompile, or disassemble the software
  • Use the software for any unlawful purpose
  • Share your license key publicly or with unauthorized users
  • Attempt to circumvent the activation or licensing system

Intellectual property

Smart Gallery Hub, its source code, design, and branding are the intellectual property of the developer. Your license grants you the right to use the software, not to own its source code or intellectual property.

Content you create, process, or manage with Smart Gallery Hub remains your property. We claim no rights to your images, videos, metadata, or any other content.

Third-party services

Smart Gallery Hub integrates with third-party AI services including Ollama and OpenAI-compatible APIs for metadata generation. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.

Payment processing

Payments are processed by Polar (Polar Software Inc.), acting as Merchant of Record. Polar handles billing, tax collection, and refund processing. Their terms: https://polar.sh/legal/terms

Disclaimer of warranty

Smart Gallery Hub is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the software will be error-free, uninterrupted, or compatible with all systems or third-party services.

Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Smart Gallery Hub, including but not limited to loss of data or loss of revenue.

Our total liability for any claim arising from these terms or the software shall not exceed the amount you paid for your license.

Governing law

These terms are governed by the laws of Hong Kong SAR. Any disputes shall be resolved in the courts of Hong Kong SAR.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the website. Continued use of the software after changes constitutes acceptance of the updated terms.

Privacy Policy

Smart Gallery Hub (“SGH,” “we,” “our”) respects your privacy. This policy explains what data we collect, how we use it, and your rights.

The desktop application

Smart Gallery Hub is a local-first desktop application. Your images, videos, metadata, AI-generated content, agency logins and earnings data stay on your computer. We do not upload, transmit, or store any of your files on our servers. Your agency logins go directly from your computer to each agency’s website and never pass through our servers.

SGH contacts our servers only for the following:

  • Update check. Each time SGH starts, it downloads a small file from dl.smartgalleryhub.com to see whether a new version is available. We count these downloads to see roughly how many copies of SGH are in use.
  • License. When you activate Smart Gallery Hub Pro, your email address and license key are sent to our license service, which checks them with Polar. Paid licenses are re-checked from time to time.
  • Remote access (optional). When you use remote access, SGH looks up your public IP address through smartgalleryhub.com (or api.ipify.org as a backup). If you claim a free DDNS name, SGH sends your public IP address to our DDNS service about once an hour, so that the name keeps pointing to your computer.

Also:

  • No cloud storage. All data is stored in a local SQLite database on your machine.
  • AI. Local AI (Ollama or llama.cpp) runs entirely on your hardware. If you choose a cloud AI provider (for example OpenAI, Google Gemini or Anthropic), the content you process is sent to that provider under their privacy policy — not ours.

The website (smartgalleryhub.com)

This website is a static site hosted on Cloudflare Pages. We may use Cloudflare Web Analytics, which collects anonymous, aggregate traffic data without cookies or personal identifiers.

We do not use Google Analytics, Facebook Pixel, or any third-party tracking scripts.

Purchases

Payments are processed by Polar (Polar Software Inc.), which acts as our Merchant of Record. When you purchase Smart Gallery Hub Pro, Polar collects your name, email, billing address, and payment information. We do not store your credit card details.

Support emails

If you email us at [email protected], we receive your email address and message content. We use this only to respond to your inquiry.

How we use your data

  • Purchase data (name, email): to deliver your license key and provide support.
  • License checks (email, license key): to confirm that your Pro license is valid.
  • Update-check counts: to know roughly how many copies of SGH are in use.
  • DDNS (public IP address, only if you claim a DDNS name): to keep your remote address working.
  • Support emails: to respond to your questions.
  • Anonymous web analytics (if enabled): to understand which pages visitors view.

We do not sell, share, or rent your personal data to third parties.

Data retention

  • License data: retained as long as your license is active.
  • Support emails: retained for up to 2 years, then deleted.
  • Web analytics: anonymous, aggregate data only; no personal data retained.

Your rights

You have the right to:

  • Access the personal data we hold about you
  • Correct inaccurate data

Cookies

This website does not use cookies.

Children’s privacy

Smart Gallery Hub is not directed at children under 13. We do not knowingly collect personal data from children.
