These terms govern your use of Smart Gallery Hub (“SGH”) and the purchase of Smart Gallery Hub Pro. By using the software or purchasing a license, you agree to these terms.

License grant

Upon purchase of Smart Gallery Hub Pro, you are granted a personal, non-exclusive, non-transferable license to use the software on up to 10 (ten) devices that you own or control.

This license is perpetual — it does not expire. The version of SGH Pro you have installed will continue to work indefinitely.

Updates entitlement

Your license includes access to all updates and new versions released within 365 days (one year) of your purchase date.

After one year:

Trial

Smart Gallery Hub Pro includes a 30-day free trial with full Pro functionality. No credit card is required to start the trial. At the end of the trial, the application is locked until a valid Pro license is activated.

Refund policy

We offer a 14-day refund guarantee from the date of purchase. If you are unsatisfied with Smart Gallery Hub Pro for any reason, contact us within 14 days for a full refund. Refunds are processed through Polar.

Activation limit

Each license key may be activated on up to 10 devices. If you need to transfer an activation to a new device, deactivate the old device first through the application settings, or contact support for assistance.

Intellectual property

Smart Gallery Hub, its source code, design, and branding are the intellectual property of the developer. Your license grants you the right to use the software, not to own its source code or intellectual property.

Content you create, process, or manage with Smart Gallery Hub remains your property. We claim no rights to your images, videos, metadata, or any other content.

Third-party services

Smart Gallery Hub integrates with third-party AI services including Ollama and OpenAI-compatible APIs for metadata generation. Your use of these services is governed by their respective terms of service and privacy policies. We are not responsible for the availability, accuracy, or policies of third-party services.

Payment processing

Payments are processed by Polar (Polar Software Inc.), acting as Merchant of Record. Polar handles billing, tax collection, and refund processing. Their terms: https://polar.sh/legal/terms

Disclaimer of warranty

Smart Gallery Hub is provided “as is” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the software will be error-free, uninterrupted, or compatible with all systems or third-party services.

Limitation of liability

To the maximum extent permitted by law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Smart Gallery Hub, including but not limited to loss of data or loss of revenue.

Our total liability for any claim arising from these terms or the software shall not exceed the amount you paid for your license.

Governing law

These terms are governed by the laws of Hong Kong SAR. Any disputes shall be resolved in the courts of Hong Kong SAR.

Changes to these terms

We may update these terms from time to time. Material changes will be communicated via the website. Continued use of the software after changes constitutes acceptance of the updated terms.
